The inmates gossiped, grinding ear-to-ear about it for hours nonstop.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>By the time the rumor reached the doorstep of the Correctional officers in charge, they had to put plans in place to \u2018smuggle\u2019 Malami and wife on self-recognizance into newly refurbished and upgraded Abba Kyari\u2019s, Nigeria Police Officer\u2019s VIP cell inside Kuje prison for their safety. <\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>*Malami\u2019s son allegedly collapsed in Kuje prison, rushed to prison clinic for emergency care: <\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Considering the constant high blood pressure and anxiety associated with the son of former Attorney-General of the Federation, Abubakar Abdulaziz Malami coupled by the rodents, and mosquito infested environment of the Kuje prison, took ill, collapsed and was reportedly rushed to the Kuje Correctional Centre clinic on Tuesday.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>His hospitalization comes amid ongoing fraud allegations involving him, his father, and the fourth wife of his father, Hajia Bashir Asabe.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u201cMalami\u2019s son suddenly fell sick and was rushed to Kuje clinic to stay there for observation,\u201d a prison source said.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>The travail of the former Attorney General of the Federation posits a clear definition of the hunter being hunted down. For a revered learned silk who had held such a respectable high office in the country to have been enmeshed in such a financial mess is unprecedentedly unimaginable. The Economic and Financial Crimes Commission EFCC is currently prosecuting the former number one law officer in the country, his son and wife, for their alleged involvement in a whopping eight billion seven hundred-million-naira money laundering.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>A statement to that effect signed by the Commission\u2019s spokesperson, Dele Oyewale said that Ex-AGF Malami (SAN) was charged with sixteen count charges bordering on money laundering contrary to the money laundering (prevention and prohibition) Act of 2022). He added, \u201cThe Economic and Financial Crimes Commission, EFCC, on Tuesday, December 30, 2025 arraigned the immediate past Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN, alongside his wife, Hajia Bashir Asabe, and son, Abubakar Abdulaziz Malami, before Justice Emeka Nwite of the Federal High Court,<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Maitama, Abuja, over alleged money laundering offences to the tune of N8, 713,923, 759.49( Eight Billion,\u00a0 Seven Hundred and Thirteen Million,\u00a0 Nine Hundred and Twenty Three Thousand,\u00a0 Seven Hundred and Fifty Nine Naira,\u00a0 Forty Nine Kobo)The defendants were docked on a 16-count charge bordering on conspiracy, procuring,\u00a0 disguising, concealing and laundering proceeds of unlawful activities, contrary to the provisions of the Money Laundering (Prevention and Prohibition) Act, 2022.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><strong>\u201cAt the commencement of proceedings, prosecution counsel, Ekele Iheanacho, SAN, informed the court that the matter was for arraignment of the defendants. \u201cMy Lord, this matter is for the arraignment of the defendants on a 16-count charge dated and filed on December 23, 2025. We humbly pray that the charge be read to the defendants and their pleas taken,\u201d he said.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u201cCounsel to the defendants, J. B. Daudu, SAN, raised no objection, following which Justice Nwite ordered that the charge be read. Count one of the charge reads: \u201cThat you Abubakar Malami, SAN, and Abubakar Abdulaziz Malami, between July 2022 and June 2025, in Abuja, procured Metropolitan Auto Tech Limited to conceal the unlawful origin of the sum of N1,014,848,500.00 (One Billion, Fourteen Million, Eight Hundred and Forty-Eight Thousand, Five Hundred Naira) in a Sterling Bank Plc account, when they reasonably ought to have known that the sum constituted proceeds of unlawful activities, thereby committing an offence contrary to Section 21(c) of the Money Laundering (Prevention and Prohibition) Act, 2022, and punishable under Section 18(3) of the same Act\u201d. <\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><strong>\u201cCount five reads: \u201cThat you Abubakar Malami, SAN, Abubakar Abdulaziz Malami and Hajia Bashir Asabe, an employee of Rahamaniyya Properties Limited, sometime in September 2024, in Abuja, conspired to disguise the unlawful origin of the aggregate sum of N1,049,173,926.13 (One Billion, Forty-Nine Million, One Hundred and Seventy-Three Thousand, Nine Hundred and Twenty-Six Naira, Thirteen Kobo) paid through the Union Bank Plc account of Meethaq Hotels Limited, Jabi, between November 2022 and September 2024, contrary to Section 21 of the Money Laundering (Prevention and Prohibition) Act, 2022, and punishable under Sections 18(2)(a) and 18(3) of the same Act\u201d.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><\/span><strong><span style=\"color: #000000;\">\u201cCount six reads: \u201cThat you Abubakar Malami, SAN, and Abubakar Abdulaziz Malami, between November 2022 and October 2025, indirectly took control of the aggregate sum of N1,362,887,872.96 (One Billion, Three Hundred and Sixty-Two Million, Eight Hundred and Eighty-Seven Thousand, Eight Hundred and Seventy-Two Naira, Ninety-Six Kobo) paid through the Union Bank Plc savings account of Meethaq Hotels Limited, when they reasonably ought to have known that the funds constituted proceeds of unlawful activities, contrary to Section 18(2)(d) and punishable under Section 18(3) of the Money Laundering (Prevention and Prohibition) Act, 2022.<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><strong>Following the pleas, Iheanacho informed the court that the prosecution was ready for trial and requested a trial date. He disclosed that the prosecution had been served with a bail application by the defence a day earlier and sought time to respond.<\/strong><\/span><\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"alignnone  wp-image-15397\" src=\"https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-one.webp\" alt=\"\" width=\"817\" height=\"460\" srcset=\"https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-one.webp 710w, https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-one-300x169.webp 300w\" sizes=\"auto, (max-width: 817px) 100vw, 817px\" \/><\/p>\n<p><span style=\"color: #000000;\"><strong>\u201cIn response, Daudu urged the court to grant bail orally, contending that the alleged offences were bailable. \u201cMy Lord, having listened carefully to the 16-count charge, this is a proper case for an oral application for bail,\u201d he said, citing Abiola v. FRN. \u201cThe offences alleged are bailable, and Section 216 of the ACJA does not mandate that an application for bail must be made in writing,\u201d he said.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>\u00a0<\/strong><strong>\u201cOpposing the application, Iheanacho urged the court to discountenance the oral bail request. \u201cMy Lord, we oppose the oral application for bail. The case of Abiola v. FRN relied upon by learned silk is inapplicable,\u201d he argued. He further submitted that the court must be guided by affidavit evidence. \u201cThis is a court of record. Submissions of counsel, no matter how brilliantly presented, do not amount to evidence and cannot replace affidavit evidence,\u201d he said, warning that granting the oral application would amount to ambushing the prosecution. On the gravity of the case, Iheanacho stressed public interest considerations. \u201cThe charge before this Honourable Court borders on serious economic crimes involving complex financial networks, and public interest must be taken into account,\u201d he submitted, adding that the high office previously held by the first defendant did not entitle him to preferential treatment.<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"alignnone  wp-image-15394\" src=\"https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-four.jpg\" alt=\"\" width=\"816\" height=\"516\" srcset=\"https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-four.jpg 712w, https:\/\/nigeriastandardnewspaper.com\/a\/wp-content\/uploads\/2025\/12\/malami-four-300x190.jpg 300w\" sizes=\"auto, (max-width: 816px) 100vw, 816px\" \/><\/p>\n<p><span style=\"color: #000000;\"><strong>\u201cIn his ruling, Justice Nwite held that the prosecution must be given the opportunity to respond adequately to the bail application. \u201cHaving listened to the submissions of learned counsel, the prosecution must be allowed adequate opportunity to respond,\u201d the judge ruled.
