The Texas nurse who had $41,000 seized by US customs last autumn as she tried to travel to Nigeria to start a medical clinic has the money back but plans to continue her lawsuit against the government.<\/b><\/span><\/span><\/p>\n<p><span style=\"color: #0000ff;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>After her case attracted widespread media attention, US Customs and Border Protection (CBP) mailed Anthonia Nwaorie a cheque that she received recently.<\/b><\/span><\/span><\/span><\/p>\n<p><span style=\"color: #0000ff;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Her words: \u201cI\u2019m glad to have my money back, but this isn\u2019t over. I want to make sure nobody else has to go through what I\u2019ve been through.\u201d<\/b><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman', serif; color: #0000ff;\"><span style=\"font-size: medium;\"><b>On how law enforcement agencies conduct asset forfeiture, Nwaorie was boarding a plane in Houston last October when she was stopped by officials. CBP confiscated the $41,377 she was carrying, the bulk of which she had saved up in order to open a clinic for women and children in Imo state, where she grew up before moving to the US in 1982. The 59-year-old said she was unaware of the requirement to declare currency over $10,000 when leaving the US as well as upon arrival. <\/b><\/span><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman', serif; color: #ff0000;\"><span style=\"font-size: medium;\"><b>Though Nwaorie was not charged with a crime, CBP sent her a letter in April saying that it would return the money on the condition that she sign a \u201chold harmless\u201d agreement promising that she would never take legal action against the government over the episode. Nwaorie refused to sign and instead launched a federal class-action lawsuit earlier this month, which seeks to end the practice of requiring people to waive legal rights to get their money back. <\/b><\/span><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman', serif; color: #ff0000;\"><span style=\"font-size: medium;\"><b>Anya Bidwell, an attorney with the Institute for Justice, a not-for-profit legal group representing Nwaorie, told the Guardian: \u201cShe\u2019s still pursuing this lawsuit because she doesn\u2019t want the same thing that happened to her to happen to hundreds or even thousands of others in her situation who are legally entitled to the return of their property but are being forced to sign a hold harmless agreement waiving their constitutional rights.\u201d It would be recalled that Anthonia, a registered nurse who became a U.S. citizen in 1994, said she was boarding a flight to Nigeria from Houston with medical supplies and money intended to open a medical clinic in her home nation when she was stopped by CBP officials.<\/b><\/span><\/span><\/p>\n<p><span style=\"color: #ff0000;\">\u201c<span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>It was like I was a criminal,\u201d Nwaorie told Washington Post. \u201cI felt so humiliated, so petrified, too. They were talking among themselves, saying how this is how people smuggle money out of the country. \u2018This is how they do it.\u2019\u201d<\/b><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #ff0000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>CBP agents seized all $41,377 dollars because Nwaorie failed to declare that she was leaving the country with more than $10,000 \u2014 a requirement of which she said she wasn&#8217;t aware.<\/b><\/span><\/span><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Nwaorie was not charged with a crime.<\/b><\/span><\/span><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Nwaorie said the agency offered a \u201chold-harmless agreement\u201d in April, under which the agency said it would return all of her money if she forfeited her right to sue the federal government. But Nwaorie decided to sue the agency instead. The Institute for Justice filed a class-action lawsuit on Nwaorie\u2019s behalf against the the agency recently. The Virginia-based law firm is demanding the agency to return Nwaorie&#8217;s money without having her sign any type of written agreement <\/b><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #ff0000;\">\u201c<span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>This is just about as unconstitutional as it gets,\u201d Nwaorie\u2019s attorney, Dan Alban of the Institute for Justice, told the Post. \u201cThey\u2019re requiring her to trade her right to the property in exchange for giving up these other rights: Does she want her right to the property? Or does she want to give up her right to the First Amendment? They\u2019re sending these agreements out to not just to Anthonia but, we think, hundreds or thousands of people every year.\u201d<\/b><\/span><b> Alban wants the CBP to release an accounting of that type of data as part of the case. <\/b><\/span><\/span><\/p>\n<p><span style=\"color: #ff0000;\">\u201c<span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>This case highlights the abusiveness of civil asset forfeitures in general,&#8221; Alban continued. &#8220;It\u2019s just crazy: She\u2019s not been charged with a crime. This has really<\/b><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #ff0000;\"> <span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>disrupted her life.\u201d<\/b><\/span><b> Nwaorie said her plans to open the clinic have been suspended pending the conclusion of her legal battle. \u201cThis was my dream, that people cannot be sent away from a clinic or a hospital because they do not have money,\u201d she said. \u201cThis is something that I want to do for humanity, myself and my God, so there is nothing I would want to do to go against the law of this land to get it done.
